Your privacy is important to us. The following document is the Miller Leith privacy policy and outlines how we collect, store, and use personal information across Miller Leith Pty Ltd and all associated entities, and applies to the personal (and sensitive) information of our candidates, temporary workers, clients, suppliers and website users. We manage your personal information in accordance with the Privacy Act 1988 (the Act) and Australian Privacy Principles.

The Miller Leith privacy policy will be updated from time to time to reflect changes in law, technology and/or business operations. If changed, we will post the changes here using the same link by which you are accessing this privacy policy.

If the changes are significant, or if required by applicable law, we will contact you (based on your selected preferences for communications from us) and all our registered users with the new details and links to the updated or changed policy. If required by law, we will get your permission or give you the opportunity to opt-in to or opt-out of, as applicable, any new uses of your personal information.

Information We Collect

Miller Leith collects personal information that falls into one of two categories: 'voluntarily provided' information and 'automatically collected' information. 'Voluntarily provided' information refers to any information you knowingly and actively provide us when using or participating in any of our services and promotions. 'Automatically collected' information refers to any information automatically sent by your devices while accessing our products and services.

Personal and Sensitive Information

Personal information is information that identifies an individual and is necessary for the proper performance of our functions and activities as a Recruitment agency, and Career Services and HR Consulting provider. Sensitive information is a category of personal information that confirms, for example, information about a person’s health, criminal beliefs, racial or ethnic origin, professional or union memberships and sexuality. We will only collect sensitive information when required and with your expressed consent.

Log Data

When you visit our website, our servers may automatically log the standard data provided by your web browser. It may include your device’s Internet Protocol IP address, your browser type and version, the pages you visit, the time and date of your visit, the time spent on each page, and other details about your visit.

Additionally, if you encounter certain errors while using the site, we may automatically collect data about the error and the circumstances surrounding its occurrence. This data may include technical details about your device, what you were trying to do when the error happened, and other technical information relating to the problem. You may or may not receive notice of such errors, even in the moment they occur, that they have occurred, or what the nature of the error is.

Candidates, Temporary Workers, and Career Services

This section relates to Recruitment candidates and temporary workers employed by Miller Leith, in addition to clients who are directly undertaking a Career Services program.

Legitimate Reasons for Collecting Your Personal Information

Miller Leith will only collect personal information when required as part of our process. In which instance we only collect personal information that is reasonably necessary to provide our services to you and may occur when you do any of the following:

  • Fill out and submit one of our application forms
  • Apply to one of our jobs
  • Engage with a Miller Leith Consultant for a screening or discovery call
  • Attend a face-to-face, online or telephone interview and/or meeting
  • Register for an online account
  • Engage us for and/or enquire about our services
  • Sign up to receive updates from us via email or social media channels
  • Use a mobile device or web browser to access our online content
  • Contact us via email, social media, or on any similar technologies
  • When you mention us on social media
  • There may be other occasions when Miller Leith collects your personal information from sources such as referees or from information services providers

Purpose of Collection of Information

Miller Leith collects your personal information for the following purpose:

  • Any relevant process in assisting you with a work placement including the role applied to and/or potential future work opportunities
  • Verification of working rights in Australia
  • Career guidance or management
  • To provide you with information on upcoming events or gaining customer feedback
  • Any request by a legal or regulatory body
  • To provide you with our platform's core features and services
  • To contact and communicate with you
  • For internal record keeping and administrative purposes

If you do not give us consent to collect or store some or all your personal information, we may be limited in our ability to locate or place you in suitable work and/or provide career guidance or management services.

Disclosure of Information

Miller Leith may disclose your personal information for the purpose for which it is primarily held, for a related secondary purpose or for a lawful related purpose. This disclosure is always on a confidential basis and, where required, with your consent.

Where required, your personal information may be disclosed to:

  • Potential or actual employers
  • Miller Leith and its associated companies and employees
  • Referees
  • Third-party service providers for the purpose of enabling them to provide their services including (without limitation) IT service providers, data storage, hosting and server providers, analytics, error loggers, maintenance or problem-solving providers, marketing providers, professional advisors, and payment systems operators
  • Our existing or potential agents or business partners
    Credit reporting agencies, courts, tribunals, and regulatory authorities, in the event you fail to pay for goods or services we have provided to you
  • Courts, tribunals, regulatory authorities, and law enforcement officers, as required by law, in connection with any actual or prospective legal proceedings, or to establish, exercise, or defend our legal rights
  • An entity that buys, or to which we transfer all or substantially all of our assets and business
  • Miller Leith’s insurers

Please note: personal information collected whilst engaged in a Career Services program is highly confidential and has limited disclosure, as outlined in the Informed Consent and Confidentiality form.

Clients and Suppliers

This section relates to current, potential, or past Clients or Suppliers of Miller Leith, including engaging Miller Leith for Recruitment, Career Services (for your employees) and/or HR Consulting services.

If you are a current, potential, or past Client or Supplier of Miller Leith we may need to collect information about you or individuals at your organisation during the course of providing our services to you and/or to ensure contractual arrangements are being met. This information may include:

  • Full name
  • Business email
  • Business phone number
  • Position title
  • Business address
  • Assessment results (if undertaking a HR Consulting program)
  • Any other information disclosed by you

This information may be gained directly from you or from other sources where appropriate and in accordance with applicable laws and requirements.

Use and Management of Personal Information

Miller Leith collects your personal information for the following purpose:

  • Storing your information securely so we can contact you regarding the services we offer
  • This information may be disclosed to Miller Leith employees, associated contractors, or associated companies
  • To meet contractual and/or service agreements
  • Recording interactions (phone, email, online or in person) between you and a Miller Leith employee or contractor to ensure we provide targeted services to you
  • Marketing purposes and undertaking customer satisfaction surveys
  • To monitor your use of our website and/or online services to enhance your experience
  • To perform actions required by law

Use of Miller Leith Website and Online Services

When engaging Miller Leith’s online services or using the Miller Leith website, information may be collected from you for the following purpose:

    For advertising and marketing, including to send you promotional information about our products and services and information about third parties that we consider may be of interest to you

    For technical assessment, including to operate and improve our app, associated applications, and associated social media platforms

We may combine voluntarily provided and automatically collected personal information with general information or research data we receive from other trusted sources. For example, our marketing and market research activities may uncover data and insights, which we may combine with information about how visitors use our site to improve our site and your experience on it.

Storing Your Personal Information and Security

Personal information is held in our Candidate Record Management system, cloud-based services and where required, with third party providers. On occasion, hard copies of information are stored in a secured environment with limited access. Strict safety measures are in place to prevent loss and theft, as well as unauthorised access, disclosure, copying, use or modification.

Although we will do our best to protect the personal information you provide to us, we advise that no method of electronic transmission or storage is 100% secure and no one can guarantee absolute data security.

When using our online services, you are responsible for selecting any password and its overall security strength, ensuring the security of your own information within the bounds of our services. For example, ensuring any passwords associated with accessing your personal information and accounts are secure and confidential.

How Long We Keep Your Personal Information

We keep your personal information only for as long as we need to, ensuring it meets the primary and secondary purpose for which the information was gained. This time period may depend on what we are using your information for, in accordance with this privacy policy. For example, if you have provided us with personal information as part of creating an account with us, we may retain this information for the duration your account exists on our system. If your personal information is no longer required for this purpose, we will delete it or make it anonymous by removing all details that identify you.

However, if necessary, we may retain your personal information for our compliance with a legal, accounting, or reporting obligation or for archiving purposes in the public interest, scientific, or historical research purposes or statistical purposes.

Children’s Privacy

We do not aim any of our products or services directly at children under the age of 13 and we do not knowingly collect personal information about children under 13.

International Transfers of Personal Information

The personal information we collect is stored and/or processed in North America, Europe, Asia, Australia, and New Zealand, or where we or our partners, affiliates, and third-party providers maintain facilities.

The countries to which we store, process, or transfer your personal information may not have the same data protection laws as the country in which you initially provided the information. If we transfer your personal information to third parties in other countries: (i) we will perform those transfers in accordance with the requirements of applicable law; and (ii) we will protect the transferred personal information in accordance with this privacy policy.

Additional Disclosures for Australian Privacy Act Compliance (AU)

Where the disclosure of your personal information is solely subject to Australian privacy laws, you acknowledge that some third parties may not be regulated by the Privacy Act and the Australian Privacy Principles in the Privacy Act. You acknowledge that if any such third party engages in any act or practice that contravenes the Australian Privacy Principles, it would not be accountable under the Privacy Act, and you will not be able to seek redress under the Privacy Act.

We use 'cookies' to collect information about you and your activity across our site. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.

You can gain access to your personal information as required by law, by using the contact details below. All requests for access to personal information will be treated seriously and be dealt with promptly and in a confidential manner. Miller Leith will take all reasonable steps to provide access to your personal information within 30 days of confirmation of your request, on the basis we can accurately identify you and validate the request.

Accuracy and Correction of Personal Information

Miller Leith takes reasonable steps to ensure your information is accurate and correct. We recognise that information changes frequently; please advise your Miller Leith Consultant when your personal details change.

Non-Discrimination

We will not discriminate against you for exercising any of your rights over your personal information. Unless your personal information is required to provide you with a particular service or offer, we will not deny you goods or services and/or charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties, or provide you with a different level or quality of goods or services.

Notification of data breaches

We will comply with laws applicable to us in respect of any data breach.

Complaints

If you believe that we have breached a relevant data protection law and wish to make a complaint, please contact us using the details below and provide us with full details of the alleged breach. We will promptly investigate your complaint and respond to you, in writing, setting out the outcome of our investigation and the steps we will take to deal with your complaint. You also have the right to contact a regulatory body or data protection authority in relation to your complaint.
