Candidate Consent

The following document is the Miller Leith Pty Ltd [ABN: 43 158 627 135], including all associated entities, (Miller Leith) (‘we’, ‘us’ or ‘our’) privacy consent form and explains:

  • how we collect, store and use, and how you may access and correct your personal information;
  • how you can lodge a complaint regarding the handling of your personal information; and
  • how we will handle any complaint.

Miller Leith treats your privacy very seriously. We manage your personal information in accordance with the Privacy Act 1988 and Australian Privacy Principles (APP) and ensure all information is treated confidentially. We collect personal information about you in order to provide you with Career Services and for purposes otherwise set out in our Privacy Policy at https://www.millerleith.com.au/privacy/.

What information does Miller Leith collect? 

Personal Information is information that identifies an individual. Collection of personal information is necessary for the proper performance of our functions and activities as a Recruitment Services provider. Sensitive Information is a category of personal information that confirms, for example, information about a person’s health, criminal beliefs, racial or ethnic origin, professional or union memberships and sexuality.

Miller Leith will only collect personal (or sensitive) information when required as part of our process to deliver services. The kind of personal information that Miller Leith may collect, and hold includes: 

  • Information to identify you (including name, address, residency information, visa details).
  • Contact details (including phone number, email address).
  • Education experience and qualifications.
  • Work preferences and objectives.
  • Current and past employment details.
  • Current and expected salary.
  • Assessment results.
  • References and referee details.
  • Criminal history.
  • Professional memberships or associations.
  • Bank, tax and superannuation details (if engaged in a temporary assignment).
  • Any other information contained in your resumé (if submitted). 

Where required, Miller Leith may also collect other personal information provided by you. 

How is your information collected? 

Miller Leith collects your personal information directly from you when you fill out and submit one of our application forms, apply to one of our jobs, when you attend a face-to-face interview in our offices, or participate in an online or telephone interview. There may be other occasions when Miller Leith collects your personal information from sources such as referees or from information services providers. 

Purpose 

Miller Leith collects your personal information for the following purpose:

  • any relevant process in assisting you with a work placement including the role applied to and/or potential future work opportunities;
  • verification of working rights in Australia;
  • career guidance or management including insights, networking, or events;
  • customer satisfaction surveys; and
  • any request by a legal or regulatory body.

If you do not provide Miller Leith with consent to collect, store or disclose some or all your personal information, we may be limited in our ability to provide our services to you.

Confidentiality and disclosure

Miller Leith may disclose your personal information for the purpose for which it is primarily held, for a related secondary purpose or for a lawful related purpose. This disclosure is always on a confidential basis and, where required, with your consent.

Your personal and/or sensitive information may be disclosed to:

  • potential or actual employers;
  • Miller Leith and its associated companies and employees;
  • Referees;
  • Miller Leith’s third-party suppliers (e.g. payroll services, background screening and verification services, software or cloud-based providers);
  • professional associations or registration bodies with a legitimate interest in disclosure of your personal information;
  • workers compensation bodies;
  • Miller Leith’s insurers; or
  • any person who has a lawful entitlement to obtain your information.

Storing your personal information 

Personal information is held in our Candidate Record Management system, cloud-based services and where required, third party suppliers. Strict safety measures are in place to ensure your personal information is held in a secured environment and treated confidentially by Miller Leith staff. Miller Leith will retain your personal information for its primary and secondary purpose, unless requested otherwise.

Miller Leith takes reasonable steps to ensure your information is accurate and correct. We recognise that information changes frequently; please advise your Miller Leith Consultant when your personal details change.

You have the right to withdraw your consent to Miller Leith processing or storing your personal information at any time by providing written notice as outlined below. At your request, we will remove your personal information, excluding any information we are required to keep by law.  

Access to your personal information 

You can gain access to your personal information by using the contact details below to make a request. All requests for access to personal information will be treated seriously and be dealt with promptly and in a confidential manner. Miller Leith will take all reasonable steps to provide access to your personal information within 30 days of confirmation of your request, on the basis we can accurately identify you and validate the request.

Complaints 

If you believe that we have breached a relevant data protection law and wish to make a complaint, please contact us using the details below and provide us with full details of the alleged breach. We will promptly investigate your complaint and respond to you in writing, setting out the steps we will take to deal with your complaint and the outcome of any investigation we undertake. You also have the right to contact the Privacy Commissioner, under the Office of the Australian Information Commissioner (OAIC) in relation to your complaint.
